Nevada Consumer Health Data Privacy Policy

This policy describes Calmacular's practices concerning consumer health data for Nevada consumers under Nevada law.
1. Categories of Consumer Health Data Collected and How It Is Used
- Body and fitness profile information: height, body weight, weight history, body measurements where supported, age-related information, sex or physiological information used in fitness calculations, fitness goals, and weight-management goals. This information is processed to provide requested fitness, nutrition, trend, and planning features.
- Nutrition information: foods, meals, serving amounts, calorie and macronutrient intake, nutrition targets, and weekly nutrition-planning information. This information is processed to provide food logging, nutrition history, and calorie and macro planning.
- Workout and exercise information: workout programs, sessions, exercises, sets, repetitions, resistance, rest, effort, cardio activity, training techniques, mesocycles, and performance history. This information is processed to provide workout tracking, history, planning, and progression features.
- Activity and connected-platform information: steps, workouts, heart rate, active energy, and other compatible activity or fitness information when you authorize a supported source. This information is processed to provide activity tracking, expenditure estimates, and related features.
- Derived or inferred fitness information: calorie targets, maintenance estimates, weight trends, activity estimates, training targets, and performance trends calculated from information you provide or authorize. This information is processed to provide requested planning, tracking, and progress features.
- Health-related support information: information you voluntarily include in a support request. This information is processed to investigate and respond to the request.
2. Categories of Sources
- You, including information you enter, edit, save, log, or submit.
- Supported device, operating-system, health, activity, or wearable sources that you authorize.
- Calmacular calculations derived from information you provide or authorize.
- Third-party food or barcode information selected by you when it becomes associated with your personal records.
3. Categories of Consumer Health Data Shared
Calmacular may share the categories of consumer health data described in Section 1 only as necessary to provide a product or feature you request, operate supported cloud functionality, protect the service, comply with law, or where another lawful basis or required consent applies.
4. Categories of Third Parties and Affiliates
- Cloud hosting, database, authentication, and infrastructure providers, including Google/Firebase where used for account, synchronization, storage, or related infrastructure.
- Device, operating-system, health, or activity platforms when necessary for a feature you request or direct.
- Security, diagnostics, or support providers where necessary to provide those services.
- Governmental, regulatory, or legal recipients where disclosure is required or permitted by applicable law.
Calmacular currently has no affiliated companies with whom it shares consumer health data.
5. Purposes for Collecting, Using, and Sharing Consumer Health Data
Calmacular processes consumer health data to provide the fitness, nutrition, workout, activity, cloud synchronization, progress, support, security, and account functionality you request; to maintain and protect the service; and to comply with applicable law. Calmacular does not use personal fitness, nutrition, body-weight, workout, health, or activity information for targeted advertising.
6. How Consumer Health Data Is Processed
Consumer health data may be entered or received on your device, used by Calmacular to generate user-facing calculations or trends, stored locally, and, where supported cloud synchronization is enabled, transmitted to and stored with cloud infrastructure associated with your account. Access is limited according to the function being provided and applicable security controls.
7. How to Submit a Nevada Consumer Health Data Request
You may request confirmation of whether Calmacular is collecting, sharing, or selling consumer health data concerning you; request a list of third parties with whom applicable data has been shared or sold; request that Calmacular stop collecting or sharing applicable consumer health data; or request deletion.
Submit a request by emailing calmacular@gmail.com. You may also use applicable account or deletion controls available in Calmacular. Calmacular may take reasonable steps to authenticate your request.
8. Reviewing or Requesting Changes to Consumer Health Data
Where supported, you can review or change personal fitness, nutrition, food, body-weight, workout, program, mesocycle, activity settings, and other records through the relevant Calmacular screens. For information you cannot change in-app, contact calmacular@gmail.com.
9. Appeals
If Calmacular refuses to act on a Nevada consumer health data request, you may appeal by emailing calmacular@gmail.com with the subject Nevada Consumer Health Data Appeal. Calmacular will respond within the period required by applicable Nevada law.
10. Material Changes to This Policy
If Calmacular materially changes the categories of consumer health data it collects, uses, or shares, the categories of recipients, or the purposes described here, Calmacular will update this policy and obtain any affirmative, voluntary consent required by Nevada law before applying the new practice to consumer health data where required.
11. Third-Party Collection Across Websites or Online Services
Calmacular does not authorize third parties to collect consumer health data over time and across unrelated websites or online services for advertising or profiling when you use the Calmacular website or app. The current Calmacular website package does not include advertising pixels or third-party analytics trackers.
