Global Privacy Rights

This page supplements the Calmacular Privacy Policy. It summarizes privacy rights that may apply based on where you live and which law applies to Calmacular. It does not reduce or waive any right provided by applicable law.
European Economic Area
Where the EU General Data Protection Regulation applies, you may have rights to access personal data, correct inaccurate data, request deletion, restrict processing, object to certain processing, receive qualifying data in a portable format, withdraw consent where processing is based on consent, and lodge a complaint with a competent supervisory authority.
Calmacular processes fitness, nutrition, body-weight, workout, heart-rate, activity, and similar information only for the purposes described in the Privacy Policy and applicable feature notices. Where information qualifies as special-category health data, Calmacular will rely on an applicable Article 9 condition in addition to an Article 6 lawful basis. Where explicit consent is the appropriate condition, Calmacular will request it through an affirmative consent mechanism before the relevant processing; you may later withdraw that consent for future processing, subject to processing that remains lawful on another basis.
If EU GDPR requires Calmacular to appoint a representative in the EEA, the representative's contact information must be made available to affected users and supervisory authorities. A representative does not replace Calmacular's own responsibility for compliance.
United Kingdom
Where the UK GDPR applies, you may have rights of access, correction, deletion, restriction, objection, portability, and withdrawal of consent where consent is the applicable basis. You may also complain to the UK Information Commissioner's Office.
If UK GDPR requires Calmacular to appoint a UK representative, the representative's contact information must be made available to affected users and the ICO.
Switzerland
Where Switzerland's Federal Act on Data Protection applies, you may have rights concerning transparency, access, correction, deletion or restriction in appropriate circumstances, and cross-border transfers. Calmacular will apply the safeguards and notices required for covered processing.
International Transfers
Calmacular is operated from the United States and uses service providers that may process information in the United States or other countries. Where applicable law restricts an international transfer, Calmacular will use an applicable lawful mechanism before making the restricted transfer. Depending on the jurisdiction and provider, mechanisms may include adequacy decisions, the EU Standard Contractual Clauses, the UK International Data Transfer Agreement or UK Addendum, an applicable Data Privacy Framework participation, approved contractual clauses, consent where legally valid, or another mechanism recognized by applicable law.

Canada
Where Canadian federal or provincial private-sector privacy law applies, Calmacular will seek meaningful consent where required, taking into account the sensitivity of fitness and health-related information. Subject to applicable law, you may request access to or correction of personal information and may withdraw consent, subject to legal or contractual limits and reasonable notice. Additional provincial rights, including rights under Quebec privacy law where applicable, will be honored when they apply.
Australia
Where the Australian Privacy Act and Australian Privacy Principles apply, you may request access to and correction of personal information and may make a privacy complaint. Health information is treated as sensitive information under Australian privacy law. Where APP 8 applies to an overseas disclosure, Calmacular will address applicable cross-border requirements.
New Zealand
Where New Zealand's Privacy Act 2020 applies, you may have rights to access and correct personal information and to make a privacy complaint. Where Information Privacy Principle 12 applies to an overseas disclosure, Calmacular will use an applicable safeguard, authorization, or other lawful basis.
Brazil
Where Brazil's Lei Geral de Proteção de Dados (LGPD) applies, data subjects may have rights including confirmation of processing, access, correction, anonymization, blocking or deletion in appropriate circumstances, portability where available under applicable rules, information about sharing, information about consent choices, withdrawal of consent, and review of certain solely automated decisions. Qualifying sensitive personal data and international transfers will be handled under an applicable LGPD legal basis and transfer mechanism.
Japan
Where Japan's Act on the Protection of Personal Information applies, you may have rights concerning disclosure of retained personal data, correction of inaccurate factual data, and suspension of use or deletion in circumstances provided by law. Calmacular will handle qualifying special-care information and overseas transfers in accordance with requirements that apply to the relevant processing.
South Korea
Where South Korea's Personal Information Protection Act applies, Calmacular will provide required transparency and honor applicable rights concerning access, correction, deletion, suspension of processing, consent, and cross-border transfers. Sensitive information will receive protections required by applicable law.
Singapore
Where Singapore's Personal Data Protection Act applies, Calmacular will address applicable consent, purpose-limitation, protection, access, correction, retention, breach-notification, and overseas-transfer obligations. You may contact Calmacular using the privacy-request process below.
India
Where India's Digital Personal Data Protection framework applies to Calmacular, Calmacular will provide required notices, use an applicable lawful ground, honor applicable data-principal rights, maintain reasonable security safeguards, and follow applicable requirements concerning consent, grievances, erasure, and transfers.
South Africa
Where South Africa's Protection of Personal Information Act applies, Calmacular will process personal information under an applicable justification, apply appropriate safeguards, honor applicable access/correction/deletion rights, and address restrictions on special personal information and cross-border transfers.
Mexico and Other Latin American Jurisdictions
Where applicable privacy law grants rights of access, correction, cancellation/deletion, opposition, consent withdrawal, portability, or similar rights, Calmacular will honor those rights to the extent they apply. Country-specific transfer and sensitive-data requirements will also apply where required.
Other Jurisdictions
Other countries, states, provinces, or territories may provide additional privacy rights. Calmacular will honor rights that apply to its processing and to the requesting individual. The absence of a jurisdiction from this page does not waive a right provided by applicable law.
Automated Calculations
Calmacular uses rules and algorithms to provide user-facing fitness, nutrition, weight-trend, activity, and workout calculations. These tools are not intended to make solely automated decisions that produce legal or similarly significant effects. Where applicable law gives you rights concerning qualifying automated decision-making, those rights will be honored.
How to Make a Privacy Request
Email calmacular@gmail.com with the subject Calmacular Privacy Rights Request. You may also use applicable in-app account, correction, permission, or deletion controls.
We may request information reasonably necessary to verify your identity, account, residence, or authority to make the request. We will not ask you to send your password, authentication code, or recovery code by email.
Where applicable law allows an authorized agent or representative to make a request for you, Calmacular may request reasonable proof of authorization and identity.
Appeals and Regulatory Complaints
Where applicable law gives you a right to appeal the denial of a privacy request, contact calmacular@gmail.com with the subject Privacy Request Appeal. Where applicable law gives you the right to complain to a privacy or data-protection regulator, you may do so. Contacting Calmacular first does not limit that right.
