U.S. State Privacy Notice

Effective Date: September 17, 2026

This notice supplements the Calmacular Privacy Policy for residents of U.S. states that provide consumer privacy rights. It applies only where the relevant state privacy law applies to Calmacular and to the individual making the request.

Categories of Personal Information

Depending on how you use Calmacular, categories processed may include:


Sources

Information may come directly from you, from your use of the app, from your device or a connected health/activity platform after you grant permission, from an application marketplace or authentication provider, from service providers that support Calmacular, or from a third-party food-data source when you request a supported food or barcode lookup.


Purposes

Calmacular uses personal information to provide and personalize requested app functionality; calculate and display fitness, nutrition, weight, activity, and workout information; synchronize and restore supported account data; authenticate and secure accounts; provide support; diagnose errors; prevent fraud, abuse, and unauthorized access; maintain service reliability; manage subscriptions or entitlements where applicable; comply with law; and establish, exercise, or defend legal claims.


Disclosures

Personal information may be disclosed to service providers that perform cloud hosting, database, authentication, email, support, infrastructure, app-store, transaction, or other technical services for Calmacular; to connected services at your direction; to authorities or other parties where required or permitted by law; or in connection with a legitimate business transaction subject to applicable legal protections.

Calmacular does not make your personal fitness, nutrition, weight, workout, or activity records publicly available through ordinary app use.


Sale, Sharing, and Targeted Advertising

Calmacular does not sell personal information for monetary compensation.

Calmacular does not use or disclose personal fitness, nutrition, body-weight, workout, health, or activity information for targeted or cross-context behavioral advertising.

The current Calmacular website package does not include advertising pixels or third-party analytics trackers. If Calmacular later begins an activity that legally constitutes a sale, sharing for cross-context behavioral advertising, or targeted advertising, applicable notices and opt-out mechanisms will be provided before or when required by law.


Sensitive Personal Information

Health, fitness, account credentials, precise location if ever collected, and other information may qualify as sensitive personal information under certain state laws. Calmacular uses sensitive information for requested fitness/wellness functionality, account security, service operation, support, safety, compliance, and other purposes described in the Privacy Policy. Calmacular does not use health or fitness information to build targeted advertising profiles.


Your State Privacy Rights

Depending on your state and whether the applicable law covers Calmacular, you may have rights to:


California Notice at Collection

For California consumers where the CCPA applies, the categories described above are collected for the purposes described in this notice and the Privacy Policy. Calmacular does not sell personal information for monetary compensation and does not use health and fitness information for cross-context behavioral advertising. Retention depends on the type of information, the period an account remains active, feature needs, security and support needs, transaction or entitlement integrity, legal requirements, dispute resolution, and the deletion process described in the Privacy Policy and Account Deletion page.

Calmacular does not offer a financial incentive or price/service difference in exchange for permission to sell personal information.


Opt-Out Preference Signals

Because the current Calmacular website does not engage in covered sale or targeted/cross-context behavioral advertising, there is no separate website advertising opt-out to apply today. If covered activity is introduced in the future, Calmacular will honor legally required recognized opt-out preference signals, such as Global Privacy Control, where applicable.


Submit a Request

Email calmacular@gmail.com with the subject U.S. State Privacy Request, or use available in-app controls for correction, permissions, or deletion.

Calmacular may request information reasonably necessary to verify your identity, account, residence, or authorized-agent status. We will not ask you to send your password or authentication codes by email.


Appeal

If your state gives you the right to appeal a denied privacy request, email calmacular@gmail.com with the subject Privacy Request Appeal.
