Calmacular Terms of Use

These Terms of Use govern your access to and use of the Calmacular mobile application, website, and related services.

In these Terms, "Calmacular," "we," "us," and "our" refer to the operator of the Calmacular application and related services.

By accessing or using Calmacular, you agree to these Terms of Use.

If you do not agree to these Terms, do not use Calmacular.

1. Purpose of Calmacular

Calmacular provides fitness, nutrition, workout, activity-tracking, planning, calculation, and progress-management tools.

Depending on the features available in your version of Calmacular, these tools may include:

Calmacular is not a medical service or medical device.

Information and functionality provided through Calmacular are intended for fitness, informational, educational, tracking, and planning purposes.

Calmacular does not diagnose, treat, cure, or prevent medical conditions and does not replace advice from a physician, registered dietitian, licensed healthcare professional, or other appropriately qualified professional.

You should seek appropriate professional guidance before making significant changes to your nutrition, exercise program, weight-management practices, or health routine when appropriate for your individual circumstances.

If you experience symptoms, injury, illness, or another health concern, seek appropriate medical care rather than relying on Calmacular.

3. Fitness and Nutrition Calculations Are Estimates

Calmacular may provide estimated values or calculations including:

Actual metabolism, calorie requirements, food absorption, activity expenditure, body composition, body-weight change, training performance, recovery, and fitness response can vary substantially between individuals.

Results may also be affected by factors that Calmacular cannot accurately measure or control.

Calmacular does not guarantee that any calculation, projection, target, progression recommendation, nutrition plan, workout plan, or other estimate will produce a particular result.

4. User Responsibility

You are responsible for deciding whether your nutrition, fitness, weight-management, exercise, and other health-related decisions are appropriate for you.

You are responsible for the accuracy and completeness of information that you enter, edit, import, confirm, or save in Calmacular.

Incorrect, incomplete, outdated, or misinterpreted information may result in inaccurate calculations, targets, recommendations, trends, or records.

5. Food and Nutrition Information

Food and nutrition information may come from information entered by you, starter foods provided by Calmacular, product labels, barcode lookups, third-party food databases, or other supported sources.

Third-party food databases may contain inaccurate, incomplete, duplicated, or outdated information.

You are responsible for reviewing food and nutrition information when accuracy is important to you.

Calmacular does not guarantee that food names, calories, serving sizes, measurements, macronutrients, barcode information, or other nutrition data are completely accurate or error-free.

6. Personal Food Library and Starter Foods

Calmacular may allow you to create, edit, scan, save, and maintain foods in a personal food library.

Eligible new accounts may receive starter foods when an account is initialized.

Starter foods copied into your account become part of your own personal Calmacular food library. Changes you make to your copy do not modify another user's food library.

Calmacular may update the source used to provide starter foods to future accounts without applying those changes to foods already copied into your existing personal library.

You remain responsible for reviewing the accuracy of foods in your personal library.

7. Exercise and Physical Activity

Physical exercise involves inherent risks, including the possibility of injury, illness, overexertion, or other adverse effects.

You are responsible for selecting exercises, resistance levels, training techniques, workout volume, intensity, rest periods, and other activities that are appropriate for your health, ability, experience, fitness level, equipment, and environment.

Do not perform an exercise or training method simply because it appears in Calmacular if you do not know how to perform it safely.

Calories attributed to steps, walking, cardio, resistance training, workouts, wearable activity, or other physical activity are estimates.

Actual energy expenditure can vary substantially between individuals and between measurement devices or data sources.

8. Workout Programs and Progression

Calmacular may use workout programs, prior workout history, exercise information, set information, training prescriptions, mesocycle history, and other supported information to prepare future workout targets or progression information.

Workout-related calculations and targets may consider information such as:

Workout progression is a planning tool, not a guarantee that you are physically capable of safely completing a suggested target.

You are responsible for evaluating each workout and adjusting or stopping training when appropriate.

9. Advanced Training Techniques

Calmacular may support advanced training techniques or workout structures such as supersets, circuits, tempo work, pyramids, and other supported methods.

Advanced training methods may increase fatigue, difficulty, cardiovascular demand, or injury risk.

You are responsible for understanding and safely performing any training technique that you choose to use.

10. Mesocycles and Training Plans

Calmacular may provide tools for organizing workouts into multi-week training plans or mesocycles.

Mesocycle schedules, effort targets, progression information, workout assignments, and other training-plan features are provided for planning purposes.

Calmacular does not guarantee that a particular training cycle, schedule, progression pattern, or workout frequency is appropriate for every person.

You are responsible for adjusting training based on your ability, recovery, schedule, equipment, health, and other relevant circumstances.

11. Health, Activity, and Wearable Information

Where supported, Calmacular may interact with health platforms, wearable devices, phone sensors, operating-system services, or other activity-data sources.

Information obtained from these sources may include steps, workouts, heart-rate information, active-energy information, or other compatible fitness and activity information.

Availability and accuracy depend on the applicable hardware, software, sensor, service, permissions, algorithms, and data source.

Calmacular does not guarantee that information obtained from a wearable, health platform, phone, or other external source is complete or accurate.

You should not rely on Calmacular or connected consumer fitness devices for emergency monitoring or medical diagnosis.

12. Accounts

Certain Calmacular features require an account.

You are responsible for maintaining the confidentiality and security of the credentials used to access your account.

You are responsible for activity occurring through your account except where applicable law provides otherwise.

You agree not to intentionally provide false account information, impersonate another person, or use another person's account without authorization.

You should promptly take appropriate action if you believe your account has been accessed without authorization.

Supported Calmacular data may be stored locally on your device, synchronized with cloud services associated with your account, or both.

Cloud synchronization may be used to back up, restore, or synchronize supported information between compatible devices.

Cloud synchronization depends on factors outside Calmacular's complete control, including:

Calmacular does not guarantee that every record will always be synchronized, restored, or recoverable.

Information that existed only on a device and was never successfully synchronized may not be recoverable if that device is lost, damaged, reset, or otherwise becomes unavailable.

You are responsible for reviewing important information after synchronization or restoration when accuracy or completeness is important to you.

15. Data Loss

Although reasonable measures may be used to protect and synchronize supported information, no software, device, database, network, or cloud-storage system can guarantee against all loss, corruption, synchronization failure, accidental deletion, hardware failure, or service interruption.

To the maximum extent permitted by applicable law, Calmacular does not guarantee permanent preservation or recoverability of user-created information.

16. Third-Party Services and Data

Calmacular may interact with third-party services, platforms, databases, software, operating systems, application stores, authentication providers, health platforms, cloud providers, or other infrastructure.

Calmacular is not responsible for the independent operation, accuracy, availability, security, or content of a third-party service except to the extent required by applicable law.

Calmacular and its original software, source code, branding, names, logos, designs, interfaces, graphics, exercise resources, calculations, written materials, website content, and other original content may be protected by copyright, trademark, and other intellectual-property laws.

Using Calmacular does not transfer ownership of Calmacular or its intellectual property to you.

Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the application for its intended purposes.

You may not copy, distribute, sell, license, commercially exploit, or create unauthorized derivative works from protected Calmacular content except where authorized by law or with prior permission.

19. User-Created Information

You retain whatever rights you may have in information that you create and enter into Calmacular.

By using features that require storage, processing, synchronization, backup, or restoration, you authorize Calmacular and its service providers to process that information as reasonably necessary to provide those features, subject to the Calmacular Privacy Policy.

You are responsible for ensuring that information you provide does not unlawfully infringe the rights of another person.

20. Application Availability and Changes

Calmacular may be updated, modified, improved, replaced, restricted, interrupted, or discontinued.

Features may be added, changed, redesigned, limited, or removed.

We do not guarantee that:

21. Paid Features, Purchases, and Subscriptions

Calmacular may offer paid features, subscriptions, trials, or other purchases now or in the future.

If a paid feature or subscription is offered, applicable pricing and purchasing information will be presented through the relevant purchasing system or before the purchase is completed.

Subscriptions may automatically renew when disclosed by the applicable purchasing system unless canceled according to the applicable marketplace or subscription terms.

Purchases made through Apple, Google, or another application marketplace may be processed by that marketplace and may also be subject to its payment, renewal, cancellation, and refund rules.

Calmacular does not guarantee that functionality made available without charge will remain free indefinitely.

Future versions of Calmacular may require payment, a subscription, a different service level, or acceptance of updated terms for continued access to some or all functionality, subject to applicable law and applicable marketplace requirements.

22. Free Trials and Promotional Access

If Calmacular offers a free trial, introductory period, promotional access, or other temporary benefit, the applicable duration and terms will be presented when that offer is made.

Unless otherwise stated, promotional or trial access may expire or convert to a paid offering according to the terms disclosed through the applicable purchasing system.

Eligibility for promotional access may be limited and may not be available to every user or account.

23. Refunds

Refund eligibility for purchases made through an application marketplace is generally governed by the applicable marketplace's rules and procedures.

Where Calmacular directly processes a payment in the future, any applicable refund terms will be disclosed through the relevant purchasing process.

You may request deletion of your Calmacular account and associated account information.

Signing out, uninstalling Calmacular, removing health permissions, or deleting individual records is not the same as requesting deletion of your entire account.

27. Suspension or Termination

Access to Calmacular may be suspended, restricted, or terminated when reasonably necessary to:

31. App Store and Platform Terms

Your use of Calmacular may also be subject to the rules and terms of the application store, operating system, device platform, payment provider, or other service through which you obtain or use the application.

If there is a conflict between these Terms and non-waivable requirements imposed by applicable law or an application marketplace, those requirements will apply to the extent required.

32. International Use

Calmacular may not be available or appropriate for use in every country or jurisdiction.

If you access Calmacular from another jurisdiction, you are responsible for complying with laws applicable to your use of the service.

33. Changes to These Terms

These Terms may be updated as Calmacular changes, new features are introduced, paid services are introduced or modified, service providers change, business practices evolve, or legal requirements change.

When these Terms are materially updated, the effective date shown at the top of this page will be revised.

Where required, additional notice or consent may be provided before materially updated Terms become effective.

34. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.

35. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

36. Entire Agreement

These Terms, together with the Calmacular Privacy Policy and any additional terms presented for a specific feature, purchase, subscription, promotion, or service, constitute the agreement governing your use of Calmacular to the extent permitted by applicable law.
